Guardianship — What Happens If Something Happens to You Too

This is a hard thing to think about when you are already in the middle of loss. But it is one of the most important things you can do for your children, and it cannot wait indefinitely.

If you died without a will or without a named guardian, the court would decide who raises your children. That decision would be made by a judge who does not know your family, your values, or your children. It would be made based on legal standards, not on your wishes.

You can prevent that uncertainty with a will that names a guardian.

If your husband's will named you as the guardian — which is standard — that provision protected the children when he died. Now that you are the surviving parent, you are the guardian by default. But if something were to happen to you, the named successor guardian in his will (if there was one) would apply. If there was no will, or no successor guardian named, the court steps in.

Here is what to do.

**Update or create your own will immediately.** This is the most urgent legal task in the immediate aftermath of loss for any widow with minor children. An estate attorney can draft a basic will quickly — often within a week or two — and the cost is typically a few hundred to a few thousand dollars depending on complexity.

**Name a guardian you trust completely.** Think about who shares your values, who your children know and love, who has the capacity and willingness to raise them. Have the conversation with that person before naming them — this should not be a surprise.

**Name a backup guardian.** If your first choice is unavailable or unwilling, you want a named alternative rather than leaving it to the court.

**Also name a separate financial trustee if appropriate.** The person best suited to raise your children emotionally may not be the best person to manage their inherited assets. You can name different people for each role.
